Medicaid Eligibility & Planning
Obtaining Medicaid eligibility is a complicated and difficult task for adult children and spouses. Medicaid is a need-based program administered by the state government in the state in which you live, using funding from the federal government and the state. Medicaid is ever changing and subject to constant review and amendment by the federal government.
It is possible to prepare a specific plan for clients and their family members, that enables them to maintain financial stability and still be eligible for Medicaid. As family estate planning, tax and benefits attorneys, we will advise in the preparation of an effective Medicaid plan based upon our client’s specific financial situation.
Long term care planning advice includes the preparation of a Medicaid plan that is specific to an individual’s personal situation. A plan for an individual with modest assets can be quite different from a plan for a person with substantial assets. We thoroughly evaluate our client’s entire situation, including income, savings, and assets. We are highly skilled in helping individuals protect assets.
The Deficit Reduction Act of 2005 was enacted in an effort "to slow the pace of spending growth in both Medicare and Medicaid." The signing of the Act has resulted in complications to obtaining Medicaid and Medicare coverage. Among these changes are new restrictions on transferring assets to qualify for Medicaid long term care and nursing home care. We will advise our clients on their entitlements and eligibility and create and draft plans to enable clients to make serious decisions on these very important family matters.
We work closely with financial professionals, insurance experts, and accountants to assist clients with the many unique needs and concerns regarding Medicaid eligibility and planning.
